Transmission of data to third countries

9(1) Subject to the provisions of this Law, transmission of data which has undergone processing or is intended for processing after its transmission to any country shall be permitted after a license of the Commissioner. The Commissioner shall issue the license only if he considers that the said country ensures an adequate level of protection. For this purpose, he shall take into consideration the nature of the data, the purposes and duration of the processing, the relevant general and special rules of law, the codes of conduct and the security measures for the protection of data, as well as the level of protection in the countries of origin, transmission and final destination of the data

Transfer of data to EU Member states

9(4) Notwithstanding the provisions of subsection (1), the transmission of data to Member-States of the European Union is free.
